As advocates await the U.S. Supreme Court ruling, which will decide the fate of DACA recipients, the Board of Immigration Appeals, or BIA, recently issued Matter of J-J-G-, a decision that takes aim at the exceptional and extremely unusual hardship standard for non-Lawful Permanent Resident cancellation of removal applications. The BIA’s decision claimed to “clarify” the respondent’s burden of proof when a qualifying relative has a medical condition.
